Joe Giudicewon’t be going home after he’s released from prison.

TheReal Housewives of New Jerseystar, 48, will be transferred directly to an immigration detention center after he is released from prison on Thursday, a source confirms to PEOPLE.

According to the source, he will remain there indefinitely as he awaits his deportation ruling.

Joe isserving a 41-month prison sentenceformail, wire and bankruptcy fraudthat began in March 2016. His wifeTeresa, 46, served a little over 11 months in prison herself for the same crimes and wasreleasedon Dec. 23, 2015.

In October, an immigration court ruled todeport Joeto hisnative Italyafter his prison sentence. (Even though he has lived in the United States since he was a child, henever obtained American citizenship, and immigrants can be deported if they are convicted of “a crime of moral turpitude” or an “aggravated felony,” according to U.S. law.)

He filed anappealagainst the order in November, but a final decision has not yet been made.

While they wait for the judge’s final ruling, Teresa has admitted thatshe and Joe would go their separate ways if he is deported.

“I’m not doing a long distance relationship. I’m not doing it,” she said on this month’sRHONJseason 9 reunion. “I want somebody with me every day.”

She also said that moving to Italy with the four daughters just isn’t in the cards.

“Unless my kids say, ‘Mommy, we want to move to Italy,’ [we] are not going,” she said. “Gia’s going to college next year; I haven’t spoken toMilaniaor Audriana about it, we haven’t gotten there yet; and Gabriella already voiced her opinion to me. She was like, ‘That would be so hard for me, Mommy.’ She doesn’t speak the language. She’s like, ‘That would kill me even more.’”

“It’s like starting a whole new life,” she added. “And they’ve been through so much already.”

The Bravo star has since been spottedwithout her wedding ring. However, her attorney has insisted everything is fine with the Giudices.

“There is no cheating, no divorce,” lawyer James Leonard Jr.told PEOPLElast month. “End of story.”
